Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HSBHAPG website, application forms, family portal, and any related services offered by Heavens Spectrum & Behavioral Health Au Pairs Global ("HSBHAPG," "we," "our," or "us"). By accessing our website, submitting an application, enrolling in a Family Consortium™, or using our portal, you agree to be bound by these Terms and by our Privacy Policy.

If you do not agree to these Terms, please do not use our services.

HSBHAPG is a private, compatibility-based placement institution. We assess family needs, curate professional candidates, and coordinate placement relationships through a proprietary methodology. Our services include family application and household assessment, candidate identification and curation, placement coordination, Priority Interim Placement™ where offered, and continuity support for enrolled families.

HSBHAPG is not a caregiver marketplace, a staffing agency, or an employer of the professionals placed with families except where expressly stated in an executed agreement. The specific services, fees, and obligations applicable to you are defined in the agreement you execute with us; those executed agreements control wherever they differ from these general Terms.

You must be at least eighteen (18) years of age to submit an application or enroll in our services. All information you provide in any application, assessment, or discovery process must be truthful, complete, and submitted by an authorized member of your household.

We reserve the right, at our sole discretion, to decline, suspend, or discontinue any application or engagement. HSBHAPG does not guarantee acceptance into any Family Consortium™, and enrollment is always subject to assessment, verification, and completion of our placement process.

Our placement process — including household assessment, verification, safeguarding, and compatibility evaluation — exists to protect the children and families we serve. These steps are not optional and cannot be waived for convenience, payment, or standing.

PAYMENT DOES NOT REPLACE SAFEGUARDING. Enrollment or payment does not entitle any family to bypass, shorten, or predetermine the outcome of any verification or assessment step.

HSBHAPG does not guarantee a particular professional, a particular placement, or any placement within a specific timeframe. Compatibility and safety considerations govern all matching decisions.

Consortium fees, placement fees, and any other amounts payable are as set out in your executed agreement. Payments are processed through our authorized payment channels only. All payment obligations are governed by the executed agreement, which controls the timing, amounts, and any applicable cancellation or refund provisions.

Special or custom configurations are valid only when documented and executed by an authorized HSBHAPG signatory. No verbal statement, proposal, or draft creates an obligation on our part.

When using our website or portals, you agree not to: misrepresent your identity or household; submit false or misleading information; attempt to gain unauthorized access to any account, record, or system; scrape, harvest, or export data belonging to HSBHAPG or other users; interfere with the operation of our services; or use our services for any unlawful purpose.

Portal accounts are personal. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

Confidentiality is the foundation of our institution. Families agree to keep candidate and professional information received through our process confidential, and HSBHAPG maintains the confidentiality of family information as described in our Privacy Policy.

Families further agree not to seek to arrange placements, engagements, or other arrangements with professionals introduced through HSBHAPG outside our process, during or after their engagement, without our prior written authorization.

All content on our website and portals — including text, design, methodology, curricula, assessments, branding, and the HSBHAPG name and marks — is the property of HSBHAPG or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

Assessments, training materials, and examination content are never to be copied, recorded, shared, or published.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, HSBHAPG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

To the fullest extent permitted by law and by the terms of your executed agreement, HSBHAPG's aggregate liability arising from or related to these Terms or our services is limited as set out in your executed agreement, and in no event will we be liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in these Terms limits any liability that cannot lawfully be limited, including with respect to the safety of children.

We may suspend or terminate access to our services for conduct that violates these Terms, endangers any child or professional, breaches confidentiality, or otherwise disrupts our institution. Where an engagement is governed by an executed agreement, suspension and termination are handled under that agreement.

You may stop using our services at any time; obligations already accrued under your executed agreement survive.

HSBHAPG reserves the right to update these Terms at any time. We will notify active members of material changes via the contact information on file. Continued use of our services following any changes constitutes acceptance of the revised Terms.
